Abortion and person right from view of philosophy

(openPR) - the questions are as complex, which are the difficult topic of legal and moral evaluation of abortions and a so-called right to birth, can be measured only with difficulty. From philosophical perspective there mostly completely different connecting factors than in result the everyday discussion. The expenditure for January of the E-journal PHILOSOPHY MONTHLY LETTER published by the Bonn consulting agency Apeiron lights up the problem therefore from different sides. - An excerpt:
„To the large topics, which lead again and again in right-nationally organized systems to violent discussions and bipolar Lagerbildung, the difficult problem area of the abnormal termination of unborn life belongs. The legal situation in Germany excludes itself with the fact such that a fundamental prohibition exists, which actual action execution is differently rated however under certain conditions. The problem is obviously complex.
In the opinion the lawyers is the action of a person in case of one „abortion “in principle as illegal procedure to be judged not to occupy the acting person however in case of the fulfilment unity of certain conditions („indication regulation “) with punitive measures. Such a special arrangement points on a fundamental ambiguity of the underlying right terms and is not meant to that extent not to end. The reasons for this are various and primarily from emotions, prejudices and reflection lacking certainly.
If one wants to approach the difficult topic appropriately, then it is meaningful to regard her from different angles and above all the ethical-moral from the legal (and thus justiziablen) side to separate. A discussion, which particularly clearly reflects this problem and urgently (on) to clarifying requires, is led under the keyword of the so-called „right to birth “. Indiscriminate is here from a something crude, because undifferentiated right term the speech, which between positive right with respect to the sense of the lawyers on the side and ethical-moral „right “on the other side does not differentiate. How it is spoken undifferentiatedly here shows up in addition, in it that in all rule no consciousness seems to prevail of each right and each authorization corresponding obligation or obligation (also here legal or ethical) defines, now once at all only the term of right. Quite and right obligation are thereby just as itself mutually causing terms as for instance inside and outside, above and down, on the left and on the right - and who without the other one thinks one, must get caught inevitably in contradictions.
The question is legal in this special connection, whether the existence of a right to birth can be stated reasonably or a bare Unbegriff is, as moral. “
