House search with anti-fascists - HU Marburg criticizes illegal resolution of an embarrassed judge

Citizen right organization since 1961 (openPR) - against the house search with the Amöneburger physicist Dr. Ulrich Brosa on Thursday (4 January) protests the Humanisti union (HU). The HU-Ortsverband Marburg regards the action as an unconstitutional chicanery of the anti-fascist.

Against 9.30 o'clock officials appeared to the Kriminalpolizei with a search warrant before Brosas door on Thursday morning. Had signed it the Amöneburger office judge Laudi. The search was justified with the fact that Brosa had published a federal central extract from a register of the policeman son franc L. in the Internet, after the young man had attacked his house. Now are officials Brosas the computers, disks and CDs as well as USB sticks and other data memories for copies of his Internet sides to examine.

Brosa is accused in the search resolution that he left the excerpt further in the Internet, although he was therefore already condemned. However this judgement is not yet valid. On the other hand it had already inserted revision. Apart from the missing validity in law of the judgement the search is in the opinion the HU also illegal because it offends against the constitutional principle of the proportionateness. Loading measures may take place therefore only if other possibilities for the determination of the facts exist or are not not reasonable. Brosa does not deny at all the BZR excerpt in the Internet to have published. The search warrant contains the embarrassing explanation that rechtilches hearing was refused to the accused one of, in order not to disturb thereby the continuation of the investigation. On Brosas PC not only all store his Mails and Internet sides, but also drafts for letters in legal procedures after its information.

Besides the physicist works also frequently on his computer, in order to program or use software high-specialized there. As particularly threatening the second chairman that feels HU-Marburg, Dragan Pavlovic the seizure of the monitoring technology before Brosas entry door: Ulrich Brosa was attacked already several times by Neofaschisten. The camera and its recordings were for it an important protection.

One could regard the search of the well-known law critic after assumptions of the HU-Ortsverbands Marburg even as revenge action. Finally he had criticized also the Amöneburger judge, who signed the search resolution against him now! “The law makes itself reliable by such actions not straight”, regretted the Marburger HU-Ortsvorsitzende Franz Josef Hanke. “Should deal you with critics grossmütig and must because of the legality principle already officially!” Hanke finds the search particularly oppressive, because with Brosa again once an anti-fascist received for the fact problems that he engaged himself against Neofaschisten.
