Court decision: Real estates will soon more expensively leave

The Federal Constitutional Court explained the tax on donations inter vivos and inheritance in its current arrangement for unconstitutional. „That has effects for the owners of real estate “, says Markus Preller, director of regional Deutschland southwest of RH/CMAX, the largest real estate network of the world. So far real estates were usually set with the tax on donations inter vivos and inheritance only with approximately 50 to 60 per cent of their market value, while other net assets were paid duty to 100 per cent. Therefore the court the legislator eliminated the unequal treatment laid on up to 31.12.2008 a reorganization to create, with the death duty. „Giving and leaving could become soon clearly more expensively “, so Markus Preller. So long the past right discharged, applies the citizens of Berlin coalition however no new law. Therefore Preller guesses/advises: „Already the switches place and with a premature donation the chance use to save within the family taxes. “
However the Karlsruher surprised judges with a further message: Due to the meaning of the dwelling for the public interest nothing in principle is to be objected to place an inheriting of real estates better. Only the present variant is unconstitutional. „This is a pleasing development “, explains Preller and hopes that the legislator will consider the suggestions of the condition judges accordingly during the reorganization of the inheritance and tax on donations inter vivos right.
