Current Turkey: Fast real estate acquisition - desire and reality

Fast land register entries - so-called Tapu - are for foreigners in Turkey still only one dream (openPR) - soon the travel season of this year and a large number of tourists begins again into Turkey will come, in order to enjoy the sea and the sun. Then the desire, not only for two or three weeks develops to spend but a longer time in the year in Turkey and if possible in its own real estate with or for others.

High season for the real estate agents. But straight in the last year did not run the business particularly well. Superelevated prices, several ten thousand not sold real estates alone to the Turkish Riviera and additionally still problems with the land register offices. That hailed the business strongly. Now one must make punctual for this year in optimism.

According to good old kind of buyer that is called first of all, all problems, which it gave in the past to represent as settled. And the problems refer in many cases to an extremely dragging land register entry.

NEW REAL ESTATE LAW SHOULD EASEMENTS FOR FOREIGNER BRINGING, HAD HOWEVER CHANGED PARTIAL

First it must be stated that the Turkish legislation on real estate for the buyer of a real estate represents a very high security of being actually also obligatory owner. Presupposed one makes everything correctly. There are nevertheless two facts, which must be considered.

To the one property may not lie in a Arial that the military explained as the safety area. On the other hand one should know that there are groups, which want to fear a sellout of the country at foreigners and to limit therefore the real estate acquisition by foreigners strongly also in Turkey.

By a new real estate law, which stepped in the past year into force, the acting government wanted to facilitate the acquisition of properties. But the law had to be first withdrawn and modified then. And since this time a fast Tapu entry is no longer possible in a land register by a foreigner, the same situation as before the change of the law.

TAPU ENTRIES IN TEN DAYS - ONLY ONE PLAN

In Turkish newspapers in the last weeks on the fact it was reported that there was to be in the future simplifications for the buyers, in order to set the demand in motion again. But this is possible only if those of military specify their safety area obligatorily and the examination, whether a property lies in such an safety area, were shifted in the long run on the regional level.

But - see above - there are circles, which are not at all interested in such a simplification of the real estate acquisition by foreigners in the Turkish society. Thus the classification of the safety areas until today is not taken place and so long remains a fast land register entry only one desire.

In some German-language newspapers, which appear in Turkey, for some weeks now the impression is aroused, as if delays are in the purchase of land in few weeks past. With headings like „Tapu distribution accelerated “however not a situation politically already abgesegnete is described, but in truth it acts thereby only the desire of the real estate industry and the building contractors.

CAUTION WITH „WINDY ONE “CONSTRUCTIONS

Who knows Turkish conditions and additionally still considered the fact that in this year extremely important elections in Turkey line up has therefore large doubts to the fact that it will give already soon the fast real estate acquisition by foreigners.

It is, one done without the only legally obligatory solution - speak: the land register entry on the own names - and leaves itself instead on windy constructions in. Of those however the ATR editorship can warn only urgently!
