(openPR) - Immobilienpool.de informs: No more cash with the auction
So far the possibility existed of depositing the security during the auction by order of the court with the court bar. This is impossible starting from 01 February 2007 by law. There is however still another temporary agreement until including 15 February 2007.
It is called literal: „A security by cash payment is impossible. “„The security can be caused by transfer on an account of the court cash, if the amount of the court cash before the auction day is credited and a proof is present concerning this in the date. The security by transfer on an account of the court cash must already take place before the auction day. “
For practice means: The security must be furnished by transfer on an account of the court cash. The transfer should take place promptly, so that sufficient time remains for the court cash to send the appropriate proof to the auction court. The auction court if this proof is not present in time, then this entails the rejection of the requirement for lack of security.
It is to be noted that the intended purpose is accurately indicated, so that the reservation of the security can take place duly. If the amount of the court cash before the auction day is not credited because of missing or wrong data and the court if the proof of the furnished security is not present with the auction day, then this entails likewise the rejection of the requirement. An account statement, the confirmation of the bank, the transfer voucher o.ä as proof of the transfer is not sufficient.
Security can be likewise furnished by a confirmed Federal Bank cheque, a bank guarantee or the crossed cheque of an entitled credit institute. With all possibilities mentioned certain basic conditions are to be considered.
